Wholesale website and order terms

These terms apply to use of the Stealth Garden wholesale website and orders for horticultural supplies. They supplement, and do not replace, the supply agreement, accepted quotation and account terms agreed with the supplier identified in your account or order documents. Those agreed terms prevail to the extent of any inconsistency, subject always to rights that cannot lawfully be excluded. These website terms do not retrospectively change an accepted order.

Accounts and lawful use

Provide accurate business, order and delivery details, keep your account credentials secure and contact us if you suspect unauthorised access. Use the website and products lawfully, and follow applicable manufacturer instructions. Do not misuse the website or infringe intellectual property rights. Catalogue listings do not confirm immediate availability or guarantee a particular growing outcome.

Orders

Identify the products, quantities and delivery street address when ordering. An order is an offer to purchase. Unless your agreed supply terms provide otherwise, acceptance occurs when Stealth Garden dispatches the ordered products, consistent with the existing wholesale ordering terms. An automated receipt acknowledgement is not itself acceptance. Contact our team about availability, errors, or requested changes or cancellations; requests are subject to the applicable agreed order terms and your statutory rights.

Prices and payment

The applicable quotation, account agreement and invoice specify the price, GST treatment and payment terms for your order. Payment terms are individually agreed; there is no universal 30-day payment period. Ask us to clarify any discrepancy before proceeding. Freight and delivery

Freight is quoted for your order. After you acknowledge the freight quote, the freight charge is added to your invoice. This is not a separate freight prepayment requirement: your approved account and invoice payment terms apply. Confirm delivery arrangements, access requirements and any special services with our team. Delivery estimates are estimates rather than guaranteed dates unless expressly agreed otherwise. Any agreed title, risk and delivery provisions remain governed by your applicable supply agreement, subject to mandatory law. See Shipping and Payments.

Returns, faults and statutory rights

Contact us with your order details and a description of the issue to discuss a return, damage, shortage or warranty enquiry. Keep relevant packaging and photographs where practical and ask about return arrangements before sending goods. Change-of-mind requests are assessed under your applicable agreed terms; this page does not promise a change-of-mind refund.

Nothing in these terms excludes, restricts or modifies any consumer guarantee, remedy or other right under the Australian Consumer Law or other law that cannot lawfully be excluded, restricted or modified. Where those rights apply, they take priority over any conflicting account or order provision. No fixed notification deadline on this page limits those rights, and responsibility for return costs is subject to applicable law. See Returns.

Please contact Stealth Garden if you need clarification about these website terms, your account agreement or an order. Updates to this page apply prospectively and do not by themselves vary existing supply agreements or accepted orders. These terms do not introduce additional credit charges, security interests, liability exclusions or waivers of statutory rights.
